Breaking: Secret Bilderberg Agenda Leaked By Mole In Switzerland

Alex Jones and Infowars.com have received inside information regarding the Bilderberg agenda now unfolding in the idyllic Swiss countryside.

According to AFP journalist and legendary Bilderberg sleuth Jim Tucker’s inside sources, the agenda now under review includes a number of critical issues at the top of the elite’s to-do list. These breakdown as follows: The elite are concerned that the American Congress may soon turn against the illegal and immoral invasion under humanitarian cover by NATO and the U.S. against the north African dictator Moammar Gaddafi.

As columnist Patrick Buchanan noted yesterday, Congress is rising in opposition to bogus wars launched by the executive branch in violation of the Constitution.

“Last week, House Speaker John Boehner had to scramble to cobble up a substitute resolution to prevent half his GOP caucus from joining with Democrats to denounce President Obama’s war in Libya as unconstitutional and to demand a total U.S. pullout in 15 days,” Buchanan wrote. More than a third of House Republicans voted to pull out of the NATO coalition attacking Gaddafi’s forces, in essence forcing a NATO withdrawal from the color revolution engineered civil war in that country.

In January, a former oil industry pastor revealed that his inside sources said oil prices will skyrocket – a fait accompli with gas prices at the pump now at historically high levels – as the global elite work behind the scenes to take down national economies. [Lindsey] Williams appeared on the Alex Jones Show to talk about new revelations that deal with the death of the dollar, exploding energy prices, and the engineered onset of order out of chaos revolution worldwide.

The elite now meeting behind closed doors in Switzerland are pushing for a wider war and incalculable suffering in the Middle East. The money masters have long profited from war and mass murder. Nathan Rothschild made a financial bet on Napoleon at the Battle of Waterloo and while also funding the Duke of Wellington’s peninsular campaign against Napoleon. The House of Rothschild financed the Prussian War, the Crimean War and the British attempt to seize the Suez Canal from the French and also financed the Mexican War and the Civil War in the U.S.

In addition to worrying about Congress waking up to the Libyan scam, the global elite are also concerned about a diverse liberty movement that has grown exponentially with the help of an open and free internet. In response, the pocketed pawns in Congress have introduced a raft of bills over the last few months designed to take down the internet and blunt its impact as a medium for alternative news and information.

On April 1, 2009, the Senate introduced two bills, endangering a free and open internet: S. 773 Cybersecurity Act of 2009 and S. 778 to establish a White House cybersecurity czar. In addition, on September 20, 2010, S. 3804: Combating Online Infringement and Counterfeits Act (COICA) was introduced.

Early last month, an especially ominous bill was introduced in the Senate. Entitled Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act of 2011, PROTECT IP for short, this legislation would use copyright infringement as a smoke screen to take down web domains and institute rolling censorship.

On the international front, the European Commission gave a nod toward implementing the Anti-Counterfeiting Trade Agreement (ACTA), a draconian measure that will subvert national sovereignty, trash Net Neutrality, consumer privacy, and civil liberties. In the United States, the corporate media has virtually ignored ACTA, but then key players in the Mockingbird media are often Bilderberg attendees and privy to aspects of the agenda.

The above represent a small sampling of legislation and treaties that will be used to shut down the opposition under the cover of protecting copyright and preventing terrorism.

Hyperventilating over exaggerated threats of cybersecurity, Senator Jay Rockefeller mused during a congressional meeting on cyber crime and terrorism in 2009: “It really almost makes you ask the question would it have been better if we had never invented the internet.”

The globalists are not opposed to the internet, especially as a corporatized money-making instrument. They are, however, opposed to an open, free, and unregulated by government internet where alternative media opposed to their globalist devices are allowed to thrive.

In addition, we can expect minions of the global elite who parade around as our elected representatives and appointed government officials to continue their propaganda efforts to convince the American people that the internet will be used as a terrorist weapon of mass destruction and as such needs to be tightly regulated – for our own safety, of course, and that of the children.

Finally, the Bilderbergers will work on an effort to sucker an already economically besieged American public into further fantastic debt producing bankster bailouts, specifically for Greece, Ireland, Portugal, and other member EU nations sliding toward bankruptcy and social disruption on a monumental scale.

In late 2010, the U.S. Treasury, now operating as a liaison between the government and the bankster owned private Federal Reserve, indicated it was ready to fork over billions more to the European black hole. “There are obviously some severe market problems,” said a faceless bureaucrat, speaking on condition of anonymity. “In May, it was Greece. This is Ireland and Portugal. If there is contagion that’s a huge problem for the global economy.”

As of late 2010, the IMF, whose biggest single “shareholder” (read: parasitical host) is the United States, has committed 250 billion euros to the bankster engineered black hole. “Why should American taxpayers be on the hook because a foreign government cannot cover its debts?” asked Rep. Ron Paul, R-Texas, at a House subcommittee hearing last May.

Because the plan is to take down national sovereignty, impose drastic austerity measures, hold fire sales on national assets, consolidate wealth and power, and use an endless economic crisis as an excuse to usher in world government, a one-world currency, and a sprawling high-tech police state.

U.S. Government Ordered Cell Phone Tracking Over A Decade Ago

Forget the iPhone scandal, the FCC mandated that all wireless carriers be able to locate their users way back in October 2001… The controversy generated as a result of computer researchers discovering a hidden file that allows Apple to track the location of iPhone and iPad users has been treated as a shocking revelation by the media, and yet since October 2001, the FCC has mandated that all wireless carriers track the location of their users down to within 50 feet.

“Stunned iPhone and iPad owners have only just found out that all of their movements are tracked and stored in a hidden iOS file which gets synced to their PC every time they connect the phone,” reports Gadgets and Gizmos. “The name of the file is Consolidated.db and it uses the Apple devices’ GPS function to record your location and the time you were there.”

The secret file was found by computer experts and made public at the recent Web 2.0 conference in San Francisco.

The Wall Street Journal expanded on the revelations surrounding Apple on Friday by reporting that Google’s Android smart phones also, “Regularly transmit their locations back to…Google, according to data and documents analyzed by The Wall Street Journal—intensifying concerns over privacy and the widening trade in personal data.”

Technology writers are seemingly baffled as to why top smart phone producers like Apple and Google are tracking the movements of their users, while lawmakers have also begun asking questions of Apple CEO Steve Jobs.

A bizarre initial reaction to the story from some quarters of the media and industry centered around the suggestion that the hidden file was “actually a bug which Apple should be looking to fix,” a theory dismissed almost instantly after it was confirmed other smart phone manufacturers were also tracking their users and that such efforts were “clearly intentional, as the database is being restored across backups, and even device migrations.”

Indeed, as much as a year ago Apple admitted to the fact that it “intermittently” collects location data, including GPS coordinates, of many iPhone users and nearby Wi-Fi networks and transmits that data to itself every 12 hours, according to a letter the company sent to U.S. Reps. Edward Markey (D-Mass.) and Joe Barton (R-Texas),” reports the WSJ.

Google’s HTC Android phones collect location data every few minutes and transmit that information directly to Google several times an hour, including the unique phone identifier, meaning that Google can keep tabs on the movement of a known individual almost constantly. Since people now ubiquitously carry their cellphones everywhere they go, this is akin to having a tracking microchip implanted in your forehead.

However, far from being a recent phenomenon, as the media would have us believe, tracking of individuals via their cellphones has been going on for almost ten years at least.

Under the 1996 Telecommunications Act, the FCC mandated that by October 1, 2001 a quarter of all new cellphones be equipped with GPS functionality that would allow authorities to track the location of users. By the end of 2002, this became a mandatory requirement of all new cellphones.

As Geek.com reported back in October 2001, “Because cellphone calls to 911 (estimated at around 140,000 per year) do not give the 911 operator location information, the FCC mandated that wireless companies “be able to locate 67 percent of callers to 911 within 50 meters that elect the handset solution while those using network technology must be able to locate the caller within 100 meters.” Wireless companies must also have one-quarter of the new cellphones they offer equipped to provide that location information by the end of the year, and all new cellphones so equipped by the end of next year.”

As a PC World article written in August 2001, two months before the first phase of the new FCC rules were enacted, asked, “The FCC requires cell phone companies to track you, in order to find you when you call 911–but what about your privacy?”

“Cell phone tracking was propelled by the Federal Communications Commission, which adopted enhanced 911 rules to cover wireless services. For E911′s first phase, cellular carriers must be able to pinpoint, to the nearest cell tower, the location of someone calling 911. For Phase II, carriers must be able to pinpoint a 911 caller’s location to within 50 to 300 meters,” states the article.

Your cellphone has been tracking you in real time for the lion’s share of the last decade, so why has it taken the media nearly 10 years to notice? Because in 2001, when such measures could have been made illegal, there was no iPhone, there was no app store, and the smart phones being used were extremely crude compared to today’s models, which are no less than mini-laptops.

In 2001, cellphones did little else than make calls and send text messages – these services didn’t require GPS technology. People weren’t addicted to their cellphones like they are today, they didn’t use them to catalogue, record and process every aspect of their existence.

The likes of Apple have worked hard over the last decade to make hundreds of millions of people dependent on their gadgets, creating an army of addicts who couldn’t care less that their cellphone is transmitting their every move directly to Steve Jobs. In their eyes, the choice between sacrificing their privacy and sacrificing their precious “apps” is an easy one to make. Privacy can’t book a table at a restaurant in a few taps of a finger, nor can it tell you the weather forecast or where the nearest ATM is located.

If the debate had been allowed to run its course in 2001, when cellphone tracking was first being adopted, the outcome may have been different. But since cellphone companies have been tracking their users for the best part of a decade, in line with government mandates, the recent controversy is merely part of the acclimatization process to achieve calm subservience and acceptance of the fact that true privacy is dead, and as Henry Blodget explains, Apple’s omnipresent brainwashing campaign has helped keep the outrage to a minimum.

Japan: Nuclear Disaster Crisis And The NWO Depopulation Agenda

Is it possible that the radiation released from Japan’s Fukushima Daiichi nuclear plant is intended to sicken and harm the populations of Japan, Hawaii and the United States?   There is evidence that suggests that the disaster fits neatly into the globalists’ well-documented plan to significantly reduce the world’s population.

The Fukushima Nuclear Crisis

After experiencing a devastating earthquake, resulting tsunami and leaking nuclear reactors, the Japanese government’s priority is not in saving lives and rebuilding Japan’s infrastructure, but rather saving a financial asset of Tokyo Electric Power Company (the nuclear facility) at the expense of the health and safety of the entire Northern Hemisphere. 

It has been over a week since Fukushima Reactor 3 exploded releasing deadly radiation. Reactor 4 is known to be leaking as well. Nonetheless, the Japanese government still has not covered the reactors with concrete and sand to stop the radiation leak, as was eventually done at Chernobyl.  

The leaking reactors could have been covered and sealed in a matter of days, if not hours, using aircraft to drop tons of sand and concrete around the clock. Instead, Japan continues the risky venting of radioactive gas to relieve a new spike in pressure in its troubled nuclear reactors.

While the initial damage to the nuclear plant could be attributed to the tsunami that devastated Japan (a natural event assuming that HAARP or other technology was not involved), the lack of government action to protect the public demonstrates extreme incompetence of Japanese Prime Minister Naoto Kan, if not malice.

Contrary to government propaganda distributed by the mainstream media, there is no safe dose of radiation. Dr. Chris Busby, Scientific Secretary of the European Committee on Radiation Risk, states that the leaked radiation from Fukushima will have a negative health impact on the people of Japan and the United States. 

After days of delay, “Japan’s Nuclear and Industrial Safety Agency admitted that the disaster was a level 5, which is classified as a crisis causing ‘several radiation deaths’ by the UN International Atomic Energy.” As Paul Joseph Watson writes, governments have a history of deceiving the public in times of crises:

“The same people telling us that the levels are miniscule and the radiation ‘harmless,’ are from the same organizations who assured us that the Chernobyl disaster only killed 9,000 people, when in reality it exposed 550 million Europeans, and 150 to 230 million others in the Northern Hemisphere to notable contamination and led to nearly a million deaths.”

Japan is already facing a food safety crisis due to the radioactive fallout. “Tests found levels of radioactive iodine up to seven times the legal limit in samples of raw milk, spinach and two leaf vegetables as far away from the nuclear plant as Chiba prefecture, to the east of Tokyo.” California and the Unites States may face a similar problem as the jet stream has already carried the toxic radiation from Japan across the Pacific Ocean.

Depopulation Agenda

This prolonged nuclear crisis at Fukushima may be tied to the depopulation agenda laid-out in Ecoscience, co-authored by Obama’s top science and technology advisor, John P. Holdren, in which he advocated the formation of a “planetary regime” that would use a “global police force” to enforce totalitarian measures of population control, including forced abortions, mass sterilization programs conducted via the food and water supply, as well as mandatory bodily implants that would prevent couples from having children.

The Globalist depopulation agenda has a history of using radiation against populations in lands with natural resources to be conquered. In her Global Research article entitled From Hiroshima to Iraq, 61 years of Uranium Wars, world renowned geoscientist, Leuren Moret, writes:

“The conduct of secret nuclear wars since 1991, through the use of depleted uranium weaponry by the United States and Great Britain with their allies, has taken place in the Middle East, the former Yugoslavia, Afghanistan and Lebanon. It has been carried out for the express purpose of destroying the public health and mutilating the genetic future of vast populations in oil rich and/or pipeline regions…

“Carpet and grid bombing with depleted uranium weaponry in Iraq, Yugoslavia and Afghanistan has guaranteed permanent radioactive terrain contamination. The recent discovery that U.S. depleted uranium bombs dropped by Israel on Lebanon in 2006 contained enriched uranium suggests covert testing of fourth generation nuclear weapons.”

Perhaps the uncapped leaking Fukushima reactors are being used to reduce the population of Japan, the United States, and Europe, in a manner that allows for plausible deniability.

Conclusion

A few years from now people in the Northern Hemisphere will likely experience increased rates of cancer, birth defects, and other health issues triggered by the Fukushima radiation release. Most people will not connect the dots as to the cause of their suffering; and, even if they do, will have trouble proving the link and obtaining compensation for their injuries.

Prime Minister Kan and Barack Obama have once again revealed themselves as powerless puppets of the global elite. Rather than bury the Fukushima plant a half mile deep in sand and concrete to protect the public, they allow toxic radiation to continue leaking which could possibly cause millions of injuries and a contaminated food supply. 

Who cares if millions of lives are endangered and the workers trying to stop the Fukushima meltdown sign their own death certificates? The important thing is that the reactors are eventually saved and restored to generate further profits for Tokyo Electric Power Company. Business as usual in the New World Order.

The people of Japan and all those affected must hold their government officials, and their global elite handlers, accountable for failing to seal the reactors.

Gaddafi Blames Libyan “Unrest” On Al Qaeda And Osama Bin Dead

Libyan leader says protesters are young people being manipulated by al-Qaeda, as violence continues across the country…

Muammar Gaddafi, the Libyan leader, has said in a speech on Libyan state television that al-Qaeda is responsible for the uprising in Libya.

“It is obvious now that this issue is run by al-Qaeda,” he said, speaking by phone from an unspecified location on Thursday.

He said that the protesters were young people who were being manipulated by al-Qaeda’s Osama bin Laden, and that many were doing so under the influence of drugs. “No one above the age of 20 would actually take part in these events,” he said. “They are taking advantage of the young age of these people [to commit violent acts] because they are not legally liable!”

At the same time, the leader warned that those behind the unrest would be prosecuted in the country’s courts. He called on Libyan parents to keep their children at home. “How can you justify such misbehaviour from people who live in good neighbourhoods?” he asked.

The situation in Libya was different to Egypt or Tunisia he said, arguing that unlike people in the neighbouring countries, Libyans have “no reason to complain whatsoever”. Libyans had easy access to low interest loans and cheap daily commodities, he argued. The one reform he did hint might be possible was a raise in salaries.

‘Symbolic’ Leader

Gaddafi argued that he was a purely “symbolic” leader with no real political power, comparing his role to that played by Queen Elizabeth II in England. He also warned that the protests could cut off Libya oil production. “If [the protesters] do not go to work regularly, the flow of oil will stop,” he said.

Ibrahim Jibreel, a Libyan political activist, said that the fact that Gaddafi was speaking by phone showed that he did not have the courage to appear publically, and proved that he remained “under self-imposed house arrest in Tripoli”.

Jibreel said there were similarities between Thursday’s speech and one Gaddafi gave earlier in the week. “The theme of people who have taken pills and hallucinations is one that continues to occur,” he said. Jibreel noted Gaddafi’s reference to loans and that he would reconsider salaries. “I think that there [are] some concessions that he wants to make, in his own weird way,” he said.

Struggling

Gaddafi is struggling to maintain his authority in the country, as major swathes of territory in the east of the vast North African country now appear to be under the control of pro-democracy protesters.

Ali, an eyewitness to the shooting, told Al Jazeera by phone that soldiers began shooting at peaceful protesters on Martyrs’ Square with heavy artillery at around 6am and had continued for 5 hours. “They were trying to kill the people, not terrify them,” he said, explaining that the soldiers had aimed at the protesters’ heads and chests.

He estimated as many as 100 protesters had been killed. Approximately 400 people had been injured and were now in the town’s hospital. He said he had filmed the bodies after the shooting had stopped, but was unable to send the footage because internet access has been cut off.

“The people here didn’t ask for anything, they just asked for a constitution and democracy and freedom, they didn’t want to shoot anyone,” he said. Gunfire could be heard in the background as Ali spoke, and he said the protesters were expecting the soldiers to launch another direct attack on Martyrs’ Square later in the evening. Despite the risk of more shooting, he said he and the other protesters would continue their protest, even if it cost their lives.

Mosque ‘Attacked’

Also on Thursday, a Libyan army unit led by Gaddafi’s ally, Naji Shifsha, blasted the minaret of a mosque being occupied by protesters in Az Zawiyah, according to witnesses.

According to witnesses, pro-Gaddafi forces also attacked the town of Misrata, which was under the control of protesters. They told Al Jazeera that “revolutionaries had driven out the security forces”, who had used “heavy machine guns and anti-aircraft guns”.

They said the pro-Gaddafi forces were called the “Hamza brigade”. Similar clashes have also been reported in the cities of Sabha in the south, and Sabratha, near Tripoli, which is in the west. Anti-government protesters appeared to be in control of the country’s eastern coastline, running from the Egyptian border through to the cities of Tobruk and Benghazi, the country’s second largest city.

Ahmed Gadhaf al-Dam, one of Gaddafi’s top security official and a cousin, defected on Wednesday evening, saying in a statement issued by his Cairo office that he left the country “in protest and to show disagreement” with “grave violations to human rights and human and international laws”.

Al-Dam was travelling to Syria from Cairo on a private plane, sources told Al Jazeera. He denied allegations that he was asked to recruit Egyptian tribes on the border to fight in Libya and said he went to Egypt in protest against his government’s used of violence.

Communications Blocked

Libyan authorities are working hard to prevent news of the events in the country from reaching the outside world. Thuraya, a satellite phone provider based in the United Arab Emirates, has faced continuous “deliberate inference” to its services in Libya, the company’s CEO told Al Jazeera.

Samer Halawi, the company’s CEO, said his company will be taking legal action against the Libyan authorities for the jamming of its satellite. “This is unlawful and this is uncalled for,” he said. The company’s engineers have had some success in combating the jamming, and operations were back on almost 70 per cent of the Libyan territory on Thursday, Halawi said. The blocking was coming from a location in Tripoli.

The Libyan government has blocked landline and wireless communications, to varying degrees, in recent days. Some phone services were down again on Thursday. In the town of Az Zawiyah, phone lines were working but internet access was blocked.

Nazanine Moshri, reporting from the northern side of the Tunisian-Libyan border near the town of Ras Ajdir, said that security forces were confiscating cellphones and cameras from people crossing into Tunisia. “The most important thing to them is to not allow any footage to get across the border into Tunisia,” she reported.

Capital Paralysed

Tripoli, the Libyan capital, meanwhile, is said to be virtually locked down, and streets remained mostly deserted, even though Gaddafi had called for his supporters to come out in force on Wednesday and “cleanse” the country from the anti-government demonstrators.

Libyan authorities said food supplies were available as “normal” in the shops and urged schools and public services to restore regular services, although economic activity and banks have been paralysed since Tuesday.

London-based newspaper the Independent reported, however, that petrol and food prices in the capital have trebled as a result of serious shortages. Foreign governments, meanwhile, continue to rush to evacuate their citizens, with thousands flooding to the country’s borders with Tunisia and Egypt.

CAIRO — Security forces have killed more than 80 anti-regime protesters in unrest-swept eastern Libya, Human Rights Watch said on Saturday, after Tripoli pledged to crush opposition.

On the fifth day of an unprecedented challenge to his four-decade regime, Libyan leader Moamer Kadhafi had still made no public comment although he reportedly appeared at a mass rally of supporters in the capital on Thursday.

After regime opponents had used Facebook to mobilise protests, like in neighbouring Egypt, the social networking website was blocked on Saturday and Internet connections patchy, said Internet users in Tripoli and Benghazi.

Arbor Networks, a US-based tracker of online traffic, said Internet services were cut overnight. But the capital itself remained calm on Saturday, a correspondent in Tripoli said, as state television and the official news agency JANA restricted their coverage to reports of pro-regime rallies.

“Security forces are firing on Libyan citizens and killing scores simply because they’re demanding change and accountability,” said New York-based Human Rights Watch (HRW), citing phone interviews with hospital staff and witnesses. It said thousands of demonstrators had poured out onto the streets in Benghazi and other eastern cities on Friday, a day after clashes in which 49 people were killed.

“Hospital sources told Human Rights Watch that security forces killed 35 people in Benghazi on February 18, almost all with live ammunition,” raising the tally to more than 80. At least 24 were gunned down in Benghazi and Al-Baida on a “day of anger” on Thursday, according to HRW.

Libya’s attorney general, Abdelrahman al-Abbar, has ordered an inquiry into the violence focused on the east of the country, an official in Tripoli told AFP on Saturday, on condition of anonymity. The prosecutor has called for “procedures to be expedited to judge all those who were guilty of death or looting,” the source said.

In Benghazi, Libya’s second city and hotbed of anti-Kadhafi opposition, demonstrators on Friday set fire to the headquarters of a local radio station after the building’s guards withdrew, witnesses and a security source told AFP. And Libyan newspaper Quryna reported on Friday that some 1,000 inmates had escaped from a Benghazi prison, while a security source told AFP four inmates were shot dead during a breakout bid in Tripoli.

According to a toll compiled by AFP from local sources, at least 41 people have been killed since demonstrations first erupted on Tuesday. That toll excludes two policemen newspapers said were hanged in Al-Baida on Friday. Oea, a newspaper close to Kadhafi’s reputedly pro-reform son, Seif al-Islam, said the two policemen had been strung up by demonstrators.

Security forces circled Al-Baida on Friday, a source close to the authorities told AFP, following Internet reports that protesters had seized control of the city. Another well-informed local source told AFP that 14 civilians, including protesters and members of the Revolutionary Committees, the backbone of Kadhafi’s regime, had been killed in Al-Baida.

“The response of the people and the Revolutionary Forces to any adventures by these small groups will be sharp and violent,” the Revolutionary Committees had warned on the website of its newspaper, Azzahf Al-Akhdar (Green March).

On Friday, US President Barack Obama condemned the use of violence against peaceful protesters in Libya, Bahrain and Yemen, while Britain, France and the European Union urged Libyan authorities to exercise restraint. Britain warned its citizens against all but essential travel to eastern Libya and France said it had suspended authorisation of exports of security equipment to the North African nation.

With international concerns mounting, Turkey’s Foreign Minister Ahmet Davutoglu told reporters a repatriation of his country’s nationals from Libya would “probably begin today (Saturday)”. Kadhafi, 68, is the longest-serving leader in the Arab world. His oil-producing North African state is sandwiched between Tunisia and Egypt, whose long-time leaders have been toppled by popular uprisings.

Patriot Act Vs The Fourth Amendment: Shredding The Constitution

The compromise version of the Patriot Act to which House and Senate conferees agreed last week and for which the House voted yesterday is an unforgivable assault on basic American values and core constitutional liberties. Unless amended in response to the courageous efforts of a few dozen senators from both parties, the new Patriot Act will continue to give federal agents the power to write their own search warrants — the statute’s newspeak terminology calls them “national security letters” — and serve them on a host of persons and entities that regularly gather and store sensitive, private information on virtually every American.

Congress once respected the Fourth Amendment until it began cutting holes in it. Before Congress enacted the Foreign Intelligence Surveillance Act (FISA) in 1977, Americans and even non-citizens physically present here enjoyed the right to privacy guaranteed by the Fourth Amendment. That Amendment, which was written out of a revulsion to warrants that let British soldiers look for any tangible thing anywhere they chose, specifically requires that the government demonstrate to a judge and the judge specifically find the existence of probable cause of criminal activity on the part of the person whose property the government wishes to search. The Fourth Amendment commands that only a judge can authorize a search warrant.

FISA unconstitutionally changed the probable cause of criminality requirement to probable cause of employment by a foreign government, hostile or friendly. Under FISA, if the government can demonstrate the foreign agency or employment status of the person whose things it wishes to search, the secret FISA court will issue the search warrant.

But even FISA respects constitutional liberty, since it prohibits prosecutions based on evidence obtained from these warrants. Thus, if a FISA warrant reveals that the embassy janitor is really a spy who beats his wife, he would not and could not be prosecuted for either crime because the evidence of his crimes was obtained in violation of the Fourth Amendment’s requirement of a judicial finding of probable cause of criminal activity. Instead of being prosecuted, he would be deported.

A year later in 1978, cutting yet another hole in the Fourth Amendment, Congress revealed its distaste for fidelity to the Constitution and its ignorance of the British government’s abuse of the colonists by enacting the Orwellian–named, Right to Financial Privacy Act. This statute, for the first time in American history, let federal agents write their own search warrants, but limited the subjects of those warrants to financial institutions. Just like FISA, it recognized the unconstitutional nature of evidence obtained by a self-written search warrant, and banned the use of such evidence in criminal prosecutions.

In 1986, Congress continued to cut. It disregarded yet again the Fourth Amendment’s protection of privacy when it enacted the Electronic Communications Privacy Act which allowed federal agents to serve self-written search warrants on collectors of digital financial data, but continued to recognize that evidence thus obtained was constitutionally incompetent for criminal prosecution purposes.

The deepest cut came on October 15, 2001 when Congress enacted the Patriot Act. With minimal floor debate in the Senate and no floor debate in the House (House members were given only 30 minutes to read the 315 page bill), Congress enacted this most unpatriotic rejection of privacy and constitutional guarantees. Together with its offspring the Intelligence Authorization Act for Fiscal 2004 and the Intelligence Reform Act of 2004, the Patriot Act not only permits the execution of self-written search warrants on a host of new subjects, it rejects the no-criminal-prosecution protections of its predecessors by requiring evidence obtained contrary to the Fourth Amendment to be turned over to prosecutors and mandating that such evidence is constitutionally competent in criminal prosecutions.

The new version of the Patriot Act which the Senate will debate this weekend purports to make all of this congressional rejection of our history, our values, and our Constitution the law of the land.

So, if your representative in the House has voted, or your Senators do vote, for the House/Senate conference approved version, they will be authorizing federal agents on their own, in violation of the Constitution, and without you knowing it, to obtain records about you from your accountant, bank, boat dealer, bodega, book store, car dealer, casino, computer server, credit union, dentist, HMO, hospital, hotel manager, insurance company, jewelry store, lawyer, library, pawn broker, pharmacist, physician, postman, real estate agent, supermarket, tax collectors, telephone company, travel agency, and trust company, and use the evidence thus obtained in any criminal prosecution against you.

Why would Congress, whose members swore to uphold the Constitution, authorize such a massive evasion of it by the federal agents we have come to rely upon to protect our freedoms? Why would Congress nullify the Fourth Amendment–guaranteed right to privacy for which we and our forbearers have fought and paid dearly? How could the men and women we elect to fortify our freedoms and write our laws so naïvely embrace the less-freedom-equals-more-security canard? Why have we fought for 230 years to keep foreign governments from eviscerating our freedoms if we will voluntarily let our own government do so?

The unfortunate answer to these questions is the inescapable historical truth that those in government — from both parties and with a few courageous exceptions — do not feel constrained by the Constitution. They think they can do whatever they want. They have hired vast teams of government lawyers to twist and torture the plain meaning of the Fourth Amendment to justify their aggrandizement of power to themselves. They vote for legislation they have not read and do not understand. Their only fear is being overruled by judges. In the case of the Patriot Act, they should be afraid. The federal judges who have published opinions on the challenges to it have all found it constitutionally flawed.

The Fourth Amendment worked for 200 years to facilitate law enforcement and protect constitutional freedoms before Congress began to cut holes in it. Judges sit in every state in the Union 24/7 to hear probable cause applications for search warrants. There is simply no real demonstrable evidence that our American-value-driven-constitutional-privacy-protection-system is in need of such a radical change.

A self-written search warrant, even one called a national security letter, is the ultimate constitutional farce. What federal agents would not authorize themselves to seize whatever they wished? Why even bother with such a meaningless requirement? We might as well let the feds rummage through any office, basement, computer, or bedroom they choose. Who would trust government agents with this unfettered unreviewable power? The Framers did not. Why would government agents bother going to a judge with probable cause seeking a search warrant if they can simply write their own? Big Brother must have caught on because federal agents have written and executed self-written search warrants on over 120,000 unsuspecting Americans since October 2001.

Is this the society we want? Have we ultimately elected a government to spy on all of us? The Fourth Amendment is the lynchpin of our personal privacy and individual dignity. Without the Fourth Amendment’s protections, we will become another East Germany. The Congress must recognize this before it is too late.

Napolitano Says Terror Threat In US “Most Heightened” Since 9/11

The threat of terrorism is at “its most heightened state” since the 9/11 attacks nearly a decade ago, U.S. Homeland Security Secretary Janet Napolitano said today.

“The terrorist threat facing our country has evolved significantly in the last ten years — and continues to evolve — so that, in some ways, the threat facing us is at its most heightened state since those attacks,” she said before the House Homeland Security Committee.

Her comments were a sobering reminder that the potential of another attack is real and growing, most notably from individuals radicalized inside the United States, despite elaborate security measures implemented by the government since 2001.

“One of the most striking elements of today’s threat picture is that plots to attack America increasingly involve American residents and citizens,” Napolitano said, referring to so-called homegrown terrorists fueled by the Internet and connections with operatives overseas.

More than two dozen Americans have been arrested on terrorism charges in the past two years, according to government statistics.

Fifty individuals involved in 32 high-profile terrorism plots involving al Qaeda-like ideology in the past decade were U.S. citizens at the time of their arrests, according to a study by the New York State Intelligence Center. Most were natural-born.

“[We] are now operating under the assumption, based on the latest intelligence and recent arrests, that individuals prepared to carry out terrorist attacks and acts of violence might be in the United States, and they could carry out acts of violence with little or no warning,” Napolitano said.

Napolitano made the remarks before the House Homeland Security Committee, where she testified with National Counterterrorism Center Director Michael Leiter.

“This shift is a game changer,” Republican committee chairman Rep. Peter King of New York said. “We must confront this threat.”

FBI and Justice Department officials have reported a spike in the number of terrorism-related investigations and prosecutions involving U.S. residents since 2009.

Many of the suspects — including Najibullah Zazi, who plotted New York City subway bombings in September 2009, and Faisal Shahzad, the convicted would-be Time Square bomber — lived and worked for years inside the United States before preparing their attacks.

David Headley of Chicago was convicted of a role in the November 2008 Mumbai attacks that killed more than 170 people, and Colleen LaRose, more commonly known as “Jihad Jane,” was implicated in a plot to kill a Swedish cartoonist for drawing the head of the Prophet Muhammad on the body of a dog in 2007.

Leiter said the evolution of domestic radicalism has been aided by propaganda developed by extremists and pushed on the Internet.

“This narrative — a blend of al Qaeda inspiration, perceived victimization and glorification of past homegrown plotting — addresses the unique concerns of like-minded, U.S.-based individuals,” he said.

Yemen Focus of Counterterror Effort

Homeland security officials said Yemen remains the “battleground” from which al Qaeda operatives are actively planning attacks against the United States, training recruits and coordinating plots.

The country is also home to radical Islamic cleric Anwar al Awlaki, a Yemeni-American who has used the Internet to encourage attacks from abroad.

Asked by chairman King to compare Osama bin Laden and Awlaki, Leiter said he considers Awlaki and the group al Qaeda in the Arabian Peninsula, which he leads, “probably the most significant risk to the U.S. homeland.”

Awlaki had ties to the attempted 2009 Christmas day bombing of Northwest flight 253 and last fall’s cargo bomb plot, Adam Gadahn, a top propaganda master for al Qaeda, and Omar Hammami, a U.S. citizen from Alabama turned top recruiter and lieutenant in the al Qaeda-linked Al Shabaab terrorist network in Somalia.

“He’s an extremely dangerous man. He has shown a desire to harm the United States, a desire to strike the homeland of the United States,” U.S. Attorney General Eric Holder said in December. “He is a person who — as an American citizen — is familiar with this country and he brings a dimension, because of that American familiarity, that others do not.”

Holder said that as a threat to the United States, Awlaki ranks alongside bin Laden. “He would be on the same list with bin Laden,” the attorney general said. “He’s up there. I don’t know whether he’s one, two, three, four — I don’t know. But he’s certainly on the list of the people who worry me the most.”

Napolitano and Leiter sought to reassure members of Congress and the public today that the agencies were actively working to counter the evolving dangers, including Awlaki.

Leiter said the agency’s new “pursuit groups,” created after intelligence officials failed to connect the dots and detect the 2009 Christmas Day bomb plot, have “repeatedly identified key leads that would have otherwise been missed amidst a sea of uncorrelated data.”

He also said the government has bolstered its terrorist watch lists and enhanced its search capability with a “Google-like” function. Previously, the databases could not be quickly searched or cross-referenced.

Authorities said that while the threat of homegrown terrorism remains acute, the capabilities of al Qaeda have been successfully degraded to “one of its weakest points in the past decade.”

“During the past two years, al Qaeda’s base of operations in the Federally Administered Tribal Areas [of Pakistan] has been restricted considerably, limiting its freedom of movement and ability to operate,” Leiter said. “The group has been forced to react continuously to personnel losses that are affecting the group’s morale, command and control, and continuity of operations.”
